Race-based discrimination creating hostile work environment October 14, 2025 The Complainant alleged race discrimination when Respondent’s new store manager was hostile and made it difficult for the Complainant to fulfill her duties as a front-end manager. Complainant further alleged she had no choice but to step down and work as a part-time cashier, and asserted Respondent never put her on the cashier schedule. Respondent denied the Complainant’s allegations and asserted the cashier schedule is generated by an automated program that looks at store labor needs, employee availability, and seniority, and Complainant’s limited availability that caused the system to not schedule her. A Resolution Conference was held, and the parties agreed to a settlement that included Respondent agreeing to transfer the Complainant to a different store and the Complainant agreeing to increase her availability.
